TERMS OF SERVICE

Welcome to Keisha Cakes LLC (“Keisha Cakes,” “we,” “us,” or “our”). These Privacy Policy & Terms of Service govern your use of www.keishacakes.com (the “Website”) and your purchase of cakes, cupcakes, desserts, classes, rental items, and other products or services offered by Keisha Cakes LLC.
By using our Website, submitting an inquiry, placing an order, making a payment, or purchasing our products or services, you acknowledge that you have read and agree to these policies and terms.
PART I — TERMS OF SERVICE
1. Custom Cake Orders & Quotes
Keisha Cakes LLC specializes in handcrafted, customized cakes and desserts. Because each order is individually designed and created, the final product may have artistic variations from inspiration photos, sketches, digital images, or previous Keisha Cakes designs.
We will make reasonable efforts to create your cake according to the agreed-upon design, colors, flavors, size, servings, and other specifications listed in your order.
A quote is not considered a confirmed booking until the required payment or retainer has been received and the order has been accepted by Keisha Cakes LLC.
Keisha Cakes LLC reserves the right to decline an order for any reason, including scheduling limitations, design limitations, ingredient availability, or other circumstances that would prevent us from completing an order to our quality standards.
2. Payment & Booking
For orders totaling less than $400, full payment is required to secure the order.
For orders totaling $400 or more, a 50% retainer is required to reserve the delivery or pickup date, unless otherwise agreed to in writing. Retainers are non-refundable.
Payment or the required retainer is due within 24 hours of the invoice being sent. If payment is not received within this period, Keisha Cakes LLC may release the date and make it available to another customer.
The remaining balance is due 14 days before the scheduled delivery or pickup date.
We accept major credit and debit cards through our designated payment processor and may accept cash in person. We do not accept personal checks, money orders, or eChecks.
For orders placed 14 days or less before the event date, full payment is required upon receipt of the quote/invoice, regardless of the total order amount. A rush fee may apply.
Your date is not considered secured until the required payment has been received.
3. Changes to Orders
Changes to an order must generally be requested no later than 14 days before the scheduled delivery or pickup date.
Changes requested after this deadline may not be possible and, if accepted, may result in an additional fee.
Changes may include, but are not limited to:

Pickup or delivery arrangements
Keisha Cakes LLC will determine whether a requested change can reasonably be accommodated.
4. Date Changes & Rescheduling
Requests to change an event date after an order has been booked are not guaranteed.
All date changes are subject to Keisha Cakes LLC's availability. A date change may require additional fees depending on the circumstances and amount of work already completed.
If the requested new date is unavailable, the original order terms and cancellation/refund policy will apply.
5. Refunds & All Sales Final
Because our cakes and desserts are handcrafted specifically for each customer and require advance purchasing, preparation, labor, and scheduling, all sales are final.
Except where otherwise required by applicable law or specifically stated in these Terms, Keisha Cakes LLC does not provide refunds based solely on subjective preferences regarding:

Texture
-
Color
-
Size or visual perception
-
Design interpretation
-
Personal taste
-
Aesthetic preferences
If Keisha Cakes LLC is unable to fulfill an order due to an emergency or other circumstance within our control, we will communicate with the customer and provide any refund that is specifically required under these Terms.
6. Inspiration Photos & Custom Designs
Customers may provide inspiration photos to communicate their desired style, colors, theme, or overall concept.
Keisha Cakes LLC does not guarantee an exact duplication of another baker's cake, artwork, character, logo, design, or photograph.
We will use our professional skill and artistic judgment to create an original interpretation that is as close as reasonably possible to the approved concept.
Variations may occur because of:

Differences between edible and non-edible materials
7. Color Matching
Color matching is not an exact science.
Different ingredients, icings, fondants, edible papers, food-safe dyes, and decorating materials may produce slightly different colors.
For customers requiring a specific color, we recommend providing a physical color swatch whenever possible.
Keisha Cakes LLC will make reasonable efforts to match requested colors but cannot guarantee a 100% exact color match.
8. Cake Size, Portions & Serving Information
Cake sizes and serving estimates are based on standard cake-cutting guidelines and the serving information provided with the order.
The number of servings ultimately obtained depends on how the cake is cut and served.
Keisha Cakes LLC is not responsible for the number of servings obtained if a cake is cut differently from the recommended serving method.
Customers are encouraged to follow the cake-cutting and serving instructions provided with their order.
9. Delivery
Delivery fees are calculated based on the distance from Boynton Beach, Florida to the delivery location. Our current delivery rate is $1.75 per mile, unless otherwise stated on the customer's invoice.
The customer is responsible for providing an accurate delivery address and notifying Keisha Cakes LLC of:

Gated communities

Gate codes
-
Limited or difficult parking
-
Elevators or stairs
-
Road restrictions
-
Construction
-
Event venue requirements
-
Other conditions that may affect delivery
The customer or an authorized representative should be available at the scheduled delivery time.
If no authorized person is available, delivery may be delayed, rescheduled, or otherwise handled at the discretion of Keisha Cakes LLC. Additional fees may apply.
Because cakes can be affected by heat, humidity, rain, direct sunlight, and other environmental conditions, customers should ensure that the delivery and event location is appropriate for the safe display of the cake.
10. Delivery Emergencies
In the event of an unavoidable incident during delivery, including a vehicle accident, severe road condition, or other circumstance outside our reasonable control, Keisha Cakes LLC's liability will be limited to the amount paid for the affected cake, to the extent permitted by applicable law.
If an order cannot be delivered or is irreparably damaged before delivery due to an incident attributable to Keisha Cakes LLC, we will communicate with the customer and provide an appropriate remedy, which may include a replacement or refund.
11. Customer Pickup
Customer pickup is available at the location and time designated by Keisha Cakes LLC.
Customers must arrive on time for scheduled pickup. A grace period of 10 minutes is provided.
Late pickup may result in a late fee and/or require the customer to return at another time that is convenient for Keisha Cakes LLC.
Once the cake has been released to the customer or the customer's authorized representative, the customer assumes responsibility for transporting and caring for the cake.
Keisha Cakes LLC is not responsible for damage caused after release of the cake, including damage caused by:

Improper transportation

Sudden braking
-
Speeding
-
Potholes
-
Road construction
-
Heat
-
Leaving the cake in a vehicle

Improper placement
-
Failure to keep the cake level

Other conditions outside Keisha Cakes LLC's control
We recommend transporting cakes on a flat, stable surface in an air-conditioned vehicle.
12. Cake Setup
For orders that include cake setup, Keisha Cakes LLC will place and arrange the cake according to the agreed-upon instructions.
Cakes can be heavy. The customer or venue is responsible for providing a sturdy, level table or cake stand capable of safely supporting the cake.
Keisha Cakes LLC is not responsible for damage caused by an unstable, improperly installed, or inadequate table or cake stand.
Once a cake has been set up, it should not be moved unless handled by an appropriately qualified person.
Keisha Cakes LLC is not responsible for damage caused by guests, venue staff, vendors, children, pets, or other persons after setup.
Keisha Cakes LLC may photograph the completed cake after setup for documentation purposes.
13. Outdoor Events & Weather
Cakes and desserts can be significantly affected by heat, humidity, rain, direct sunlight, wind, and other outdoor conditions.
Keisha Cakes LLC cannot guarantee the condition of cakes, icings, fillings, fondant, edible decorations, or other products after setup at an outdoor event when weather or environmental conditions negatively affect the product.
Customers are responsible for providing a suitable environment for the cake.
14. Fresh Flowers
When fresh flowers are incorporated into a cake design, the customer is responsible for communicating with the florist regarding the safety and handling of the flowers.
Fresh flowers may contain pesticides, chemicals, or other substances that are not intended for food consumption.
Customers should obtain appropriate information regarding the safety of any flowers used on or around food.
Keisha Cakes LLC recommends that customers use flowers specifically identified as appropriate for food-related applications and follow proper food-safety procedures.
15. Food Allergies & Cross-Contact
Keisha Cakes LLC products are prepared in an environment where ingredients may come into contact with common allergens.
Our ingredients and/or equipment may come into contact with:

Peanuts

Other ingredients that may cause allergic reactions
Customers must notify Keisha Cakes LLC of known allergies or dietary restrictions before placing an order.
While we will make reasonable efforts to provide accurate ingredient information and accommodate disclosed concerns when possible, we cannot guarantee an allergen-free environment or the complete absence of cross-contact.
Customers are responsible for informing guests about potential allergens in the food being served.
Individuals with severe or life-threatening allergies should use their own judgment regarding consumption.
16. Non-Edible & Decorative Materials
Some cake designs may include decorative materials that are intended for display only and should not be eaten.
These may include certain:

Other structural or decorative materials
Some decorative materials may be non-toxic but are still not intended for consumption.
Customers should ask about any decorative materials they have concerns about before approving and paying for the order.
17. Rental Equipment
If cake stands, display items, or other rental equipment are provided, rental equipment is generally provided for the day of the event unless otherwise stated in writing.
Rental equipment must be returned within two days after the event.
A late fee of $10 per day may be charged for items returned after the agreed return period.
The customer is responsible for the replacement cost of equipment that is lost, stolen, or damaged beyond reasonable wear and tear.
Replacement values will be provided as applicable in the rental agreement or invoice.
18. Photography & Marketing
Keisha Cakes LLC reserves the right to photograph cakes, desserts, displays, and event setups created by Keisha Cakes for marketing, advertising, social media, portfolio, website, and promotional purposes.
Photographs may be taken before, during, or after setup.
Keisha Cakes LLC may also photograph the surrounding cake display or event setting when reasonably necessary to showcase the work.
Keisha Cakes LLC will make reasonable efforts to avoid intentionally identifying guests or photographing individuals in a manner that suggests endorsement without appropriate permission.
If you have a specific concern regarding photography of an identifiable person, please notify us before the event.
19. Emergencies, Illness, Natural Disasters & Events Outside Our Control
Keisha Cakes LLC is currently operated primarily by its owner, Keisha Gaines.
In the event of an unexpected emergency, serious illness, family emergency, natural disaster, hurricane, flood, unsafe operating condition, government restriction, or other circumstance beyond our reasonable control, we will make reasonable efforts to fulfill the order or communicate with the customer as soon as reasonably possible.
If Keisha Cakes LLC cannot fulfill an order and the order has not already been completed, the customer will be notified and an appropriate refund will be provided for amounts paid toward the affected order, subject to the circumstances and applicable law.
Keisha Cakes LLC is not responsible for delays or failures caused by circumstances outside our reasonable control.
20. Website Content & Intellectual Property
All original content appearing on the Keisha Cakes website, including photographs, logos, branding, written content, graphics, recipes where applicable, designs, and other materials, belongs to Keisha Cakes LLC or is used with permission.
You may not copy, reproduce, modify, distribute, sell, or use Keisha Cakes' copyrighted materials, photographs, branding, or other intellectual property without written permission.

You agree to use the Website only for lawful purposes.
